These Terms and Conditions (“Terms”, “Terms and Conditions”) govern your relationship with https://www.foodiecrawls.com website (the “Service” or the “Site”) operated by Foodie Crawls LLC (“us”, “we”, “our”, or the “Company”).

The following Agreement governs your use of our Site. By accessing and using the Site, you signify and acknowledge your acceptance of this Agreement and our Privacy Policy. Your acceptance of this Agreement provides you with a limited, temporary and non-exclusive license and permission to use the resources of the Site, as well as the opportunity to purchase tickets for our food tasting events and or private group tours. This limited, temporary and non-exclusive license and permission are freely revocable at any time, for any reason whatsoever, and with or without notice, by Foodie Crawls LLC as described more fully below.

Please read these Terms and Conditions carefully before using the Service.  Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.  By accessing or using the Service you agree to be bound by these Terms.  If you do not agree to this Agreement, please do not use the Service or purchase tickets for our tours.

Purchases

If you wish to purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase including, without limitation, your credit card number, the expiration date of your credit card, your billing address, and your shipping information.

You represent and warrant that: (i) you have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase; and that (ii) the information you supply to us is true, correct and complete.

By submitting such information, you grant us the right to provide the information to third parties for purposes of facilitating the completion of Purchases.

We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, error in your order or other reasons.

We reserve the right to refuse or cancel your order if fraud or an unauthorised or illegal transaction is suspected.

Bookings:

Online Reservations can only be made with a valid credit card. Your credit card will be charged immediately when making the reservation. The charge on your credit card statement will show as Foodie Crawls.

Minimum Guest Policy:

Some group tours and activities require a minimum number of guests. In the event the minimum is not met 48 hours prior to the scheduled tour, guests will be notified by email or phone and have the option of a full refund or to rebook for a future date.

Cancellation Policy:

Due to the amount of work we put into all of our experiences to provide an exceptional level of service, please take careful note of our cancellation policies:

  • Cancellations must be communicated by email to reservations@foodiecrawls.com OR by phone no less than 72 hours prior to the scheduled departure time to request a refund.
  • Foodie Crawls retains the right to issue refunds and accommodate changes at our discretion.

Group Tours & Activities

  • Cancellations received greater than 48 hours prior to the scheduled tour are fully refundable, unless otherwise noted.
  • Cancellations received within 48 hours of the scheduled tour are non-refundable and cannot be rescheduled.
  • Amendment requests are subject to availability and price changes.

Private Group Tours & Events

A 20% deposit (to be applied to the final amount due) is required to confirm all private group bookings.  For events 2 weeks or more out this deposit is due within 48 hours after receiving your invoice.  For events 1-2 weeks out the deposit is due within 24 hours of receipt of the invoice.  Your reservation is considered confirmed only after the deposit is made.  All deposits are non-refundable.

A credit card is required to confirm all reservations.  The final quoted balance is due 72 hours prior to the scheduled reservation and will be charged to the card on file. Any overages, if applicable will be charged after the conclusion of your tour.

  • Cancellations received greater than 72 hours prior to your scheduled tour are fully refundable, minus the deposit.
  • Cancellations received within 72 hours of your scheduled tour are non-refundable.  In the event the host fails cancel or reschedule 72 hours prior to their reservation, they will be charged the full amount for the reserved passengers as quoted.
  • Amendment requests are subject to availability and price changes.
  • All cancellations and amendment requests should be sent through reservations@foodiecrawls.com.

Late Arrivals & No Shows

Late arrivals and no shows are non-refundable. This is applicable to any guest(s) that arrive after tour departure or are no shows.

Changes to this Policy

From time to time, the terms of our booking and cancellation policies may change at the Company’s discretion. In the event of such changes, the new policy will apply for all tours booked after the date and time of the policy change. Availability, Errors and Inaccuracies

We are constantly updating our offerings of products and services on the Site. The products or services available on our Site may be mispriced, described inaccurately, or unavailable, and we may experience delays in updating information on the Service and in our advertising on other web sites.

We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

In the event a product or service is listed at an incorrect price or with incorrect information due to typographical error, technology effort, error in the date or length of publication, or error in pricing or product information received from our advertisers or suppliers, you agree that the Company and the Site are not responsible for such errors or discrepancies.

Intellectual Property

The Service and its original content, features and functionality are and will remain the exclusive property of Foodie Crawls LLC and its licensors. The Service is protected by copyright, trademark, and other laws of both the United States and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Foodie Crawls LLC.

Links To Other Web Sites

Our Service may contain links to third-party web sites or services that are not owned or controlled by Foodie Crawls LLC.

Foodie Crawls LLC has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Foodie Crawls LLC shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party web sites or services that you visit.

Termination

We may terminate or suspend your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease.

Limitation Of Liability

In no event shall Foodie Crawls LLC, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Waiver and Release of Claims 

By purchasing tickets for and/or participating in the food tasting tours offered by Foodie Crawls LLC, and in consideration of being allowed to purchase said tickets and for other good and valuable consideration, the receipt and sufficiency of which is acknowledged, you understand, acknowledge, represent, warrant and agree as follows, with the knowledge that the Company will rely on same:

A. You desire to participate in the food tasting tours offered by the Company (the “Activities”);

B. You are in good health and suffer from no minor or serious physical or mental injury, illness or disability that would make you especially susceptible to injury or disability while performing any activity contemplated by this Agreement (including, without limitation, this Section – Waiver and Release of Claims);

C. You fully comprehend and accept all of the risks associated with your participation in the Activities including, without limitation, exposure to unfavorable weather conditions, food sickness, injuries (e.g., without limitation, those arising out of self-inflicted accidents or mishaps, other participants, automobiles, pedestrians and the like) and death;

D. You grant to Company the irrevocable, sub-licensable right and authority to use your name, likeness, photograph and/or picture for any and all commercial or non-commercial purposes now known or later developed in perpetuity throughout the universe without further obligation or compensation to you;

E. Your participation in the tours is at your own sole risk. You, on behalf of yourself and/or any person or entity claiming through or on your behalf, hereby forever and unconditionally release and discharge the company, the company’s related and affiliated entities, the present and former employees, owners, officers, members, managers, partners, contractors, insurers, representatives and agents of the foregoing from any and all claims, actions, damages, liabilities, losses, costs and expenses in any way arising out of, or resulting from, your participation in the tours, including, without limitation, any and all claims, actions, and liabilities for death, injury, loss or damage to you, to anyone else, or to any property, regardless of whether or not such injury, loss or damage was caused by the negligence or willful conduct of the company or any of the released parties. You, on behalf of yourself and/or any person or entity acting through or on your behalf, further agree to defend and indemnify the released parties, and to hold the released parties harmless, from any and all liabilities, claims, actions, damages, expenses (including, without limitation, attorney’s fees) and losses of any kind or nature whatsoever in any way arising out of, or resulting from, your participation in the tours;

F. This Section – Waiver and Release of Claims is in addition to, and not a limitation of, the other terms and conditions of this Agreement.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

Foodie Crawls LLC its subsidiaries, affiliates, and its licensors do not warrant that a) the Service will function uninterrupted, secure or available at any particular time or location; b) any errors or defects will be corrected; c) the Service is free of viruses or other harmful components; or d) the results of using the Service will meet your requirements.

Governing Law

These Terms shall be governed and construed in accordance with the laws of California, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
